These Terms of Use ("Terms") govern your use of the RoboKana mobile application ("App", "RoboKana"), developed by Olena Bachurina ("we", "our", "us").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
The App is licensed to you under Apple's Standard End User License Agreement ("Apple EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms set out additional provisions that apply to your use of the App. In the event of any conflict between these Terms and Apple's EULA, Apple's EULA prevails on matters within its scope; otherwise, these Terms apply.
Your use of the App is also subject to our Privacy Policy, available at https://legal.robokana.com/privacy.html. The Privacy Policy describes how we collect, use, and protect your information.
The App offers optional in-app purchases that unlock additional content. Without a purchase, the App provides a free tier with a limited subset of content.
Refunds for purchases are handled by Apple in accordance with the App Store's refund policy. To request a refund, please contact Apple Support directly through https://reportaproblem.apple.com/. We have no control over refund decisions made by Apple.
If you are a consumer in the European Union, the United Kingdom, or another jurisdiction with statutory withdrawal rights, those rights apply where they cannot be lawfully waived.
Subject to your compliance with these Terms and Apple's EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for your personal, non-commercial use.
All content within the App — including but not limited to character data, animations, audio recordings, exercises, illustrations, design, source code, and the RoboKana name and logo — is owned by us or our licensors and is protected by applicable copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership to you.
The Japanese kana and kanji themselves are part of the public-domain Japanese writing system and are not claimed as our intellectual property.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that learning outcomes will meet your expectations.
The App is an educational tool. Language proficiency depends on many factors beyond the App's scope; we do not guarantee any specific learning result.
To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of the App.
Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for App purchases in the twelve (12) months preceding the claim, or USD 100, whichever is greater.
Nothing in these Terms limits liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, or for death or personal injury caused by negligence.
You may stop using the App at any time by uninstalling it.
We may suspend or terminate your access to paid features if you materially violate these Terms. Termination of access does not entitle you to a refund except as required by applicable law or by Apple's refund policies.
The App is rated 4+ on the App Store and is not directed at children under 13. If you are under 13 (or the equivalent minimum age in your jurisdiction), you must obtain consent from a parent or legal guardian before using the App.
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. For material changes, we will provide reasonable notice through the App or on our website. Your continued use of the App after such changes indicates acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the App.
You acknowledge that Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and Apple's EULA, and Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
